By accessing or using gonocap.com and any subdomain, tool, form, portal, or communication channel we operate (collectively, the "Site"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the Site.

You must be at least 18 years old and legally able to enter into contracts to use the Site or request a quote. By using the Site you represent that you meet these requirements and that all information you submit is true, accurate, and complete.

The Site is an informational and lead-generation tool. Nothing on the Site — including quotes, illustrations, coverage descriptions, or communications with our agents — constitutes an offer of insurance, a binder, or a promise to issue coverage. Insurance coverage is bound only by a written policy issued by a licensed insurance carrier and is subject to that carrier's underwriting, terms, exclusions, and applicable state regulations.

Content on the Site is not legal, tax, accounting, or financial advice. You should consult qualified professionals for advice specific to your situation.

Any premium indication or quote presented on the Site or through our quote tools is an estimate only, based on the information provided at that moment, and is subject to change following underwriting review, verification of information, credit checks (where allowed by law), motor vehicle reports, inspections, and other carrier requirements. Final premiums and terms may differ materially.

The Site embeds or links to quote and application tools operated by third parties, including but not limited to LeadConnector, APISystem, and Propeller Bonds. These services are provided by independent third parties, are subject to their own terms and privacy policies, and are not controlled by us. We are not responsible for the availability, accuracy, security, or content of any third-party service.

You agree to (a) provide accurate, current, and complete information; (b) not submit fraudulent, misleading, or unlawful information; (c) not attempt to interfere with, reverse engineer, scrape, overload, or disrupt the Site or its underlying infrastructure; (d) not use the Site to transmit malicious code, spam, or unlawful content; and (e) comply with all applicable federal, state, and local laws.

By submitting your contact information — including through any form on the Site or its embedded third-party tools — you expressly consent to be contacted by No Cap Insurance and its authorized carriers, agents, service providers, and marketing partners at the telephone number(s), email address(es), and any other contact information you provide, regarding your quote request and related products and services. Such contact may include telephone calls, SMS/MMS text messages, email, prerecorded messages, and automatic telephone dialing systems, even if your number is on a Do Not Call registry. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of SMS messages, HELP for help, or contact info@gonocap.com to opt out of other communications.

All content on the Site — including text, graphics, logos, images, video, audio, software, and the compilation thereof — is owned by or licensed to No Cap Insurance and is protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. All other uses, including reproduction, modification, distribution, republication, framing, or commercial exploitation, are prohibited without our prior written consent.

Any feedback, ideas, or suggestions you provide about the Site are non-confidential and may be used by us without obligation or compensation.

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, UNINTERRUPTED OPERATION, OR THAT THE SITE WILL BE FREE OF ERRORS, VIRUSES, OR HARMFUL COMPONENTS. YOU USE THE SITE AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, NO CAP INSURANCE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so portions may not apply to you.

You agree to defend, indemnify, and hold harmless No Cap Insurance and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use or misuse of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any information you submit.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, epidemics, labor disputes, or telecommunications, internet, or utility failures.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Subject to Section 16 (Arbitration), the state and federal courts located in Cook County, Illinois shall have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction and venue in those courts.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, controversy, or claim arising out of or relating to these Terms or the Site ("Dispute") shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in Cook County, Illinois (or by telephone/video at the claimant's option). The arbitrator's decision is final and binding. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. If any portion of this arbitration section is found unenforceable with respect to a particular claim, that claim shall be severed and litigated in the courts identified in Section 15, but the remainder of this section shall remain in force. Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property rights, or from bringing a claim in small-claims court.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver. These Terms, together with the Privacy Policy and any policy issued to you by a carrier, are the entire agreement between you and us regarding the Site.

We may modify these Terms at any time by posting the revised version on the Site. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance. We may suspend or terminate your access to the Site at any time, without notice, for any reason, including suspected violation of these Terms.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely.
